2.3 Account Security: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. Health and Medical Disclaimer
3.1 Medical Clearance: Before beginning any fitness program, you should consult with your healthcare provider. Our Services are not a substitute for professional medical advice, diagnosis, or treatment.

This assumption of risk applies even if such risks arise from the negligence of the Company or its coaches, to the extent permitted by law.
3.4 No Medical Advice: Our coaches and trainers are not licensed medical professionals, registered dietitians, or healthcare providers unless specifically stated otherwise. Any nutritional guidance, exercise recommendations, or wellness advice provided is for general educational and informational purposes only and should not be construed as medical advice, diagnosis, or treatment. 5.6 Taxes: Unless otherwise stated in Section 5.1, all fees are exclusive of applicable taxes, duties, and government charges (including GST), which you are responsible for paying. We will add applicable taxes to your invoice as required by law.
6. Cancellation and Refund Policy
6.1 Cancellation by Client: You may cancel your subscription at any time by providing written notice through your account settings or by email to the contact address specified in Section 14. Cancellation will take effect at the end of your current billing period, and you will retain access to the Services until that time. 6.2 Refunds: All payments are non-refundable except as required by law. If you cancel your subscription, you will not receive a refund for the current billing period. However, you are entitled to statutory rights under the Australian Consumer Law, including the right to a refund, repair, or replacement if the Services provided constitute a major failure or are not provided with due care and skill. Nothing in these Terms limits or excludes any rights or remedies you may have under the Australian Consumer Law or other applicable consumer protection legislation.
6.3 Discretionary Refunds: We may, at our sole discretion, provide refunds in exceptional circumstances beyond those required by law, such as prolonged service outages or circumstances where we are unable to provide the Services as promised. Any such discretionary refund does not waive or limit your statutory rights under Section 6.2.
6.4 Cancellation by Company: We reserve the right to suspend or terminate your access to the Services at any time for cause, including for breach of these Terms. If we terminate your access without cause (other than for reasons beyond our control such as force majeure), you will be entitled to a pro-rata refund of any prepaid fees for Services not yet provided. If termination is due to your breach of these Terms or other conduct justifying termination for cause, you will not be entitled to any refund.
7. Client Responsibilities
7.1 Accurate Information: You agree to provide accurate, current, and complete health, fitness, and personal information through our intake forms and health questionnaires, and to promptly update such information whenever there are material changes to your health status, medical conditions, medications, or other circumstances that could affect your safe participation in the Services. You acknowledge that our ability to provide appropriate Services depends on the accuracy and completeness of the information you provide.
7.2 Following Instructions: You agree to follow the exercise and nutrition guidance provided by our coaches to the best of your ability, subject to your own judgment about your physical capabilities and health, and to communicate any concerns or difficulties promptly. You acknowledge that you are ultimately responsible for decisions about your own health and fitness, and you should stop any activity that causes pain or discomfort and consult a healthcare provider as appropriate.
7.3 Communication: You agree to maintain regular communication with your assigned coach and to respond to check-ins and messages within a reasonable timeframe (generally within 48 hours for non-urgent matters). You acknowledge that failure to maintain regular communication may limit our ability to provide effective Services and monitor your progress. If we do not receive a response from you within 14 consecutive days despite reasonable attempts to contact you, we may suspend your Services until communication is re-established.
7.4 Prohibited Conduct: You agree not to:
- Use the Services for any unlawful purpose

8.2 Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services and associated materials (including workout programs and meal plans provided to you) for your personal, non-commercial use only. 10.4 Jurisdictional Limitations: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
11. Indemnification
Subject to applicable law (including the Australian Consumer Law), you agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

Your statutory rights under the Australian Consumer Law are not affected by termination.
14.4 Data Retention: After termination, we may retain your information as required by law or for legitimate business purposes, in accordance with our Privacy Policy.

The remaining provisions shall continue in full force and effect. If severance of an invalid provision would fundamentally alter the nature of these Terms or would be contrary to the Australian Consumer Law, the entire Terms may be deemed void at the election of the affected party.
15.5 Assignment: You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.
